Unlocking U.S. Residency:
A Comprehensive Guide for Chinese Investors on EB-5

The EB-5 Visa offers a unique path to “buying your way into” U.S. residency and has become common for Chinese investors. What investment dollar amounts levels apply, how much US job creation (which is the purpose of the program), and which regional centers offer the best opportunities. We break down the essential elements of the EB-5 program, highlighting both Direct and Regional Center investments. Although the vast majority of our investors are US nationals we do hear from our Family Office and development colleges about utilizing the EB-5 program and will provide our prospective from the real estate operator side.

Direct EB-5 Investments

A Direct EB-5 investment involves a foreign national investing in their own business within the U.S. This approach requires:

  • Creating at least ten full-time jobs for U.S. citizens or permanent residents.
  • The limitation of one EB-5 investor per business.
  • Additionally the project must be geographically positioned in a targeted employment areas (TEAs). According to USCIS, the minimum investment for EB-5 applicants currently stands at $800,000 with in a TEA. For more details on regional centers and qualifications, visit the USCIS website.

Regional Center EB-5 Investments

The Regional Center route offers more flexibility and scalability. Here’s how:

Pooling Resources: Allows multiple investors to pool their funds into larger business projects.

Economic Impact: Regional Centers focus on economic and job creation activities across multiple businesses.

Common misconceptions on Regional Centers is that they act as umbrella organizations, not direct business operators.

Job Creation and Compliance

Remember the whole point of the EB-5 program is to create jobs in America. Whether opting for Direct or Regional Center investments, job creation is a pivotal requirement:

Direct EB-5: Requires the creation of ten full-time jobs within the investor’s business.

Regional Center EB-5: Utilizes economic modeling to count direct, indirect, and induced jobs.

Authenticating Source of Funds

One critical step for EB-5 investors is verifying the lawful source of their investment funds. Documentation is essential, whether the funds are derived from:

  • Salaries
  • Dividends
  • Real estate sales
  • Gifts
  • Sustaining the Investment

Other notes:

  • Funds must remain invested and at risk until the two-year conditional residency period ends.
  • Addressed the complexities of redeploying returned funds into new at-risk projects.

Compliance and Regulatory Requirements

The EB-5 program requires strict adherence to compliance standards:

Forms and Audits: Regional Centers must file specific forms, undergo yearly audits, and maintain transparency.

Reform Integrity Act of 2022: Introduced provisions for greater oversight, including third-party fund administrators and disclosure requirements.

Set-Aside Provisions and Visa Bulletin

New set-aside provisions under the Reform Integrity Act of 2022 benefit investors:

Rural Areas: Priority for investments in rural and high-unemployment areas.

Infrastructure Projects: Eases congestion in visa categories for countries like China and India.

The Role of the EB-5 Attorney

Attorneys role is to provide immigration advice, not investment advice. Remember to respect this distinction to avoid conflicts of interest and ensure compliance.

Converting E2 and L1 Visas to EB-5

For those on E2 or L1 visas, there’s an opportunity to convert their business investments into an EB-5 investment, facilitating a smoother transition to permanent residency.

Billing Models for Immigration Services

Set Fee: Covers a certain number of hours.

Additional Charges: Apply for services beyond the initial fee, ensuring transparency and fairness.

THE WEALTH ELEVATOR
PODCAST

begin your journey to financial freedom!

My name is Lane Kawaoka, and I hope my blog/podcast will help families realize the powerful wealth-building effects of real estate so they can spend their time on more important, instead of working long hours and worrying about their financial troubles. There are a lot of successful families with good jobs (teachers / engineers / programmers / finance) yet they struggle to make ends meet financially. It is their kiddos who ultimately get the short end of the stick. Being a Latch-Key Child growing up, both my parents had to work and I was left home alone after school to fiddle with my thumbs.

With Real Estate you are able to grow your wealth exponentially faster than the conventional 401K’s and stock investing, therefore you are able to escape the dogma of working 50+ hour weeks at a job that is unfulfilling. And if you are one of the lucky ones who happen to do what you enjoy… well good for you 😛

Money is not everything but it is important because it gives you the freedom to live life on your terms.

Annoyed by the bogus real estate education programs out there (that take money from people who don’t have it in the first place), I set out to make this free website to help other hard-working professionals, the shrinking middle-class. I hope to dispel the Wall-Street dogma of traditional wealth-building, and offer an alternative to “garbage” investments in the 401K/mutual funds that only make the insiders rich. We help the hard-working middle-class build real asset portfolios, by providing free investing educationpodcasts, and networking, plus access to investment opportunities not offered to the general public.

The true meaning of wealth is having the freedom to do what you want, when you want, and with whom you want.
Building cash flow via real estate is the simple part. The difficult part occurs after you are free financially to find your calling and fulfillment.
But that’s a great problem to have ;)”
